ERWIN — A Unicoi County grand jury returned 10 true bills on Friday afternoon charging Unicoi County Sheriff Kent Harris with 10 felony charges.
The charges include six counts of official misconduct, and one count each of tampering with evidence, criminal simulation, theft over $1,000 and attempted aggravated assault.
District Attorney General Tony Clark said the Tennessee Bureau of Investigation presented the case to the grand jury and that subpoenaed witnesses presented testimony in court on Friday. Clark said Harris was served with a criminal summons on the indictments late Friday afternoon.
“We worked diligently on these to get them presented to the grand jury today, so they were all presented today and there was a true bill returned on all counts,” Clark said.
Clark said the charges stem from a pair of TBI investigations — one initiated in 2009 and the other in 2010 — that overlapped and were eventually combined, he said. According to a TBI release, the agency began the investigation into allegations of misconduct made against Harris in September 2010 after being requested by the Clark’s office.
The TBI release states the six counts of official misconduct stem from incidences on June 23-24, June 30, July 12-13, July 15, July 17 and July 19 of 2010 when Harris allegedly had inmates at the Unicoi County Jail perform labor on property located on North Mohawk Drive that the sheriff owns.
Harris also altered or destroyed a record related to evidence or the evidence that was part of an investigation on Sept. 6, 2008, which resulted in the tampering with evidence charge, the TBI said.
Harris made or altered a memo requesting payment from Unicoi County for a vehicle that was donated to the county resulting in the criminal simulation charge, the TBI release states. The theft incident occurred on Sept. 23, 2008, when Harris received $4,500 that was property of the county, according to the TBI.
Harris was charged with attempted aggravated assault for attempting to assault a man with a deadly weapon on July 21 of this year, according to the TBI. This incident followed a meeting of the Unicoi County’s Finance Committee, when Harris confronted Unicoi County resident J.D. Hensley.
Clark said the TBI intended to arrest Harris, however he said Criminal Court Judge Lynn Brown did not feel that move would be prudent in the case. Clark said the TBI and district attorney general’s office opposed Brown’s decision.
“Judge Brown said that was his decision, that it’s his call,” Clark said. “I respectfully disagreed with him and he respectfully disagreed with me, and a summons was issued in lieu of an arrest and that’s the only explanation he gave me.”
Although Harris was not arrested, Clark said the sheriff must report to the Unicoi County Jail at some point for booking and fingerprinting. According to the TBI, Harris must appear in court within 10 days to be processed. Harris is scheduled to appear in Unicoi County Criminal Court on Nov. 22.
Clark said he has taken no personal pleasure in pursuing the case and that the case has proven to be a difficult one.
“This has been a long case,” Clark said. “There has been a lot of speculation and rumors flying around Unicoi County. I live in this county. It’s been very difficult. People have said that people were being drugged, things were being covered up. That’s not the case. The TBI did a very thorough investigation.
“It has been very difficult, it has not been an easy thing for anybody here. Sheriff Harris was a friend. I’ve known him for years, but I have a job to do. I took an oath to do what was right. I’m not saying Sheriff Harris is guilty of anything, but we certainly had the evidence, I thought, to present this case to the grand jury and that’s what we did.”
Information gleaned from witness testimony on Friday could result in other charges for Harris, Clark said.
“There is some ongoing investigation as to some other matters we’re looking into as a result of some things that came to light today,” he said.
Clark also said some witnesses offering testimony have been threatened and harassed. This activity, he said, will not be tolerated by his office and violators will be charged “without hesitation.”
Harris could not be reached Friday for comment.
Unicoi County Mayor Greg Lynch said he was unable to comment on the matter at this time.
Unicoi County Commission Chairwoman Sue Jean Wilson said the matter will be a topic of discussion at the County Commission’s planning session on Oct. 24. Wilson also said a meeting between the commissioners and County Attorney Doug Shults has been requested to see what advice Shults can offer as far as the next steps that may need to be taken.
“People are innocent until proven guilty and with none of (the commissioners) being attorneys and never having faced anything like this, we must be very careful,” Wilson said. “We want the citizens to know that we are being proactive of what is expected of us and will set up some sort of time frame for whatever steps we have to go through.”

What I don't understand is how he has held the title "sheriff" any way? He hasn't performed any of his dutie's since his "accident". I think it's been like 6-9 mo., maybe longer, since it happened and he probably hasn't even been to the police station a total of 2 weeks out of that time. How can he stay sheriff when he can't even pretend to do his job? As for these charges all I have to say is, it's about time! He has always loved getting his 5 minutes on the news telling about how him and his department are doing such a good job at getting all the criminals off of the streets of Erwin. Wonder how he feels now that the shoe is on the other foot?

Kent has done well for Unicoi County in the past, but I feel his reign has come to an end. Erwin is just like every other small town on the map when it comes to rumors and people throwing stones. I think what irks me the most is the fact that some people don't want to open their eyes to see what is going on here. All this came out a while back and everyone just suspected rumor. Well, now that the TBI has indicted Kent it doesn't seem like too much of this may have been rumor. The TBI is not your local sheriffs dept., they are not out for political gain or to tarnish someone's name. He still has his followers and that's fine, but these people have blinders on when it comes to the sheriffs dept. I feel for his family and what they are about to endure with probably even more rumors and the fact that there are still more charges that could be placed on him. It's still kind of funny to hear people talk about this situation around town. I'm sure he is a good man, but geez people this isn't one charge that has been placed. There is something going on down there and it's time the local followers of Mr. Harris realized this. I just wonder how many more within the department will either be charged or resign from their positions. I'm sure Kent wasn't acting alone in whatever he was doing behind the scenes.

Well this is a start now if they will just clean out the rest of the sheriff's office. An officer is supposed to set a good example for the community not only on the job but in their personal life and everyone one knows they have several that are worse than the people they arrest. When my son was a teenager he couldn't go out without being pulled over for what they called a suspious stop and was patted down more than once he was a good kid just driving a bad looking car which gave them no right to stop him. So TBI keep digging you may just give this town what it needs a good old fashion house cleaning.

I have been wondering how long this " I'm goina arrest everyone in the county" dogma would last. He has now put Erwin on the same map as Bluff City, places to stay away from if at all possible. More investigation by the TBI will probably reveal his accident was not sustained by a fall, rather he was hit by a speed boat while walking across Boone Lake. Hope he gets a cell with an extra bed and saves it for Judge "the Clown" Brown, hopefully he will be on the next TBI probe!!!!

My husband, father, and late grandfather are and were masons. My husband is not a devil worshipper and neither was my grandfather. My husband is a great man and by no means a liar. My grandfather made sure that I was raised in church and never missed a Sunday up until his death. To say that Masons are devil worshippers is isane. People make choices on a daily basis to do what is right, and if Mr. Kent Harris has done something wrong that doesn't make him a devil worshipper nor does it mean b/c he is a mason he felt it ok to steal and/or lie. Also, Shriners are also masons and I couldn't possibly imagine this country without their support for children with disabilities....I guess they feel it necessary to worship the devil when they stand in the street to take up money for their non profit organization to help needy children!

That being said, his crimial summons he was issued, instead of being arrested on the spot for his alleged crimes is the exact same thing he reprimanded two of his VERY BEST OFFICERS of. His 10 FELONY inditements should CERTAINLY warrant an arrest and a ride in the worn out sheriff's deputy cars he should have been maintaining and replacing had he not been stealing money from the county and the drug fund to support his illegal activites and high society way of life.
Just because you "like" someone and they are popular, DOES NOT MAKE THEM RIGHT. And I commend the TBI officals and DA Tony Clark for doing what is not so popular by prosecuting him BECAUSE IT IS RIGHT! NO ONE needs to be taking any county vehicle home. My taxes along with other citizens pay for the gas. They drive these cruisers to church in Buladean N.C., grocery stores, running around town and anywhere else they damn well please! Also why do the litter team employees need to drive a litter truck home?? One truck comes all the way to Limestone Cove; I doubt he is going to be out picking up any litter after work, since we always see inmates doing it. And who is the old man and woman that is always driving the SUV that belongs to the sheriff’s department? Could this be Grandpa and Grandma Harris? Why does any county employee driving a county car do 80 or 90 miles an hour on the interstate? This goes from the deputies to our Road Superintendent, this when their going home. We have one Johnson City cop and a Washington County cop that lives here in the county; they drive 50 miles an hour on a 30 mile zone. The deputies hide on private property with radar in Unicoi trying to catch someone. Why are these deputies above the law during work and after work hours.
The TBI needs to investigate long and hard, there is quite a few cops down there that cover up for their family and in-laws. Just a few months ago a deputies step son wrecked, drove his car on to his grandparents, two different deputies investigated this and both did nothing. A lot of evidence is destroyed before the TBI can get there on some cases. Lack of evidence gets them off every time. And they will never give you the police report or let you hear the 911 recordings.
Maybe they will also go in up at Rock Creek Park and check out the party pad that the married deputies like to meet their little girlfriends to on county time. Yep that camper has been a rocking good time for many.....And guesses what folks its UCSD property meaning we paid for it.

This is the way peoples minds work as an elderly person. They get a call each day asking if they are alright and if they need anything. Now, the only thing wrong with that is that almost all elderly, independent and proud citizen that the sheriffs office calls will say that they are fine even if they are about to die. With the elderly people having some attention makes them feel good and in turn they will vote for the person that they feel is giving them the attention they deserve. Now, guess what the percentage of the elderly voters make up? Oh, before you say that I don't know what I'm talking about, one of the elderly people that I spoke of is my mother. I just wonder if Greg Lynch had guts enough to put Kent's butt of the tax payers back and do the right thing by putting the crook out of there. We need to start with a new sheriff and all new deputies. Yes, all new deputies. They are all too snug and comfortable in their position they forget what they need to do or who the are working for (the people of Unicoi county). Clean house and get some deputies in there that can at least run 100 yards and not have a heart attack or stroke and can apprehend someone younger than their parents..........

We as citizens of Unicoi County may not know for sure where our sheriff department is headed, along with Mr. Harris. Now I have a few questions to ask of our citizens. Our county commissioners gave Mr. Harris some $800,000 for his budget, while wanting to cut other departments, are they one of his co-conspirator's? Do you think that he used threats, intimidation and harrassment on them as well to get what he wanted? I hope that the DA office and/or our commissioners will do the right thing that's best for the citizens of Unicoi County and be free of any and all thrests, intimidation and harrassments.

Anyone that would down the Shriners and the Masons have no creditability with me.Shriners do great things in our community.I am not a Shriner or a Mason,but I know many of them.I support Sheriff Harris he has done good for our county.I have been an Union man for 22 years.My father and his father were Union men until they retired.Alot of the people that are pushing this ,run sweat shops in Unicoi County.One of them is right in front of the CSX car shop.I know employees that work there that tried to get jobs at Union Companys.They were given days off for putting in applications. this should be against the law.INNOCENT UNTIL PROVEN GUILTY!!!!!

I am in no way a Kent Harris supporter. I believe that he should have been arrested and made post bail, the same as I would have been if charged with 10 felonies.
I am offended by some of the comments regarding the deputies of the UCSD. Not everyone associated with UCSD is a crook or a dirty cop. I have a family member that is a deputy of this county and not one time has he ever gotten me out of any speeding ticket that I have ever gotten and he treats everyone the same. He even arrested his own brother for a DUI.
Just because our so called sheriff is a loser and is quilty of making bad decisions, not everyone in this county is crooked.
I am proud to be a resident of Unicoi County and believe that the citizens of this county need to make better choices when election time rolls around.

It sure is a shame that an elected official gets charged with 10 felonies here in this county and is able to maintain his position. This so called Sheriff has made people charged with misdemeanors post a bond .while he is able to walk around free {without posting a bond} and trying to work on the sympathy of the citizens of Unicoi County. It is just my opinion that the County Commission that we elected to represent us should at least STOP PAYING this man. If he is found not guilty then he can collect his back pay. Or he could be put on Work Release and work out at Rock Creek Park like he had one of his State Prisoners working. Lets Get Him OFF THE PAYROLL.

i know the name, simply because i can read....but as far as the person himself....i do not know him nor do i know anything about erwin's political ring....what i do know is what i have seen in the past as far as proper procedure is concerned...the man should have been forced to follow what any other person is forced to do...he should have posted a bond....period....and he should have been put on administrative leave immediately when indicted, until he has his day in court and "proved the falsehood" of the accusations...just like anyone else would have to do....it is the "special treatment" that i object to...no matter how good or not that he is supposed to be..

For as far as I'm concerned Washington County can have him, at least he won't be stealing Unicoi County tax dollars then.
I personally as tired of paying his salary...it's about time he goes.

Does anyone know how deputy harris got all these properties? Does he have money in the family or has he been up to something else. Heard some weird things about this guy.
